Zapable – Terms of Service (TOS)

1. What Zapable Is
Zapable is an online marketplace that allows:
- Creators to upload digital products and sell them.
- Buyers to purchase digital products directly from creators.
- Bitcoin payments to occur directly between buyers and creators (“peer-to-peer”), using Lightning invoices or on-chain transactions to the creator's own wallet.
- Card payments to be processed by Stripe directly on the creator's own Stripe account. The creator is the merchant of record for card sales; Zapable does not receive or hold those funds.
We do not:
- Hold customer funds
- Take custody of Bitcoin
- Operate as a financial intermediary
- Guarantee or insure payments
- Control or reverse Bitcoin transactions
Bitcoin and Lightning payments are final and handled directly by users' own wallets. Refunds for those payments are the responsibility of the creator, not Zapable.
2. Eligibility
To use Zapable, you must:
- Be at least 18 years old
- Be legally capable of entering contracts
- Not be prohibited from using Bitcoin or online marketplaces under your local laws
- Agree to comply with these Terms and our Acceptable Use Policy (AUP)
3. Your Account
You must create an account to upload or purchase digital products. You agree to:
- Provide accurate information
- Maintain the security of your account
- Not impersonate others
- Not register accounts on behalf of others without permission
You are responsible for all activity under your account.
4. Payments and Fees
4.1 Bitcoin Payments (Lightning and on-chain)
All Bitcoin payments, whether over the Lightning Network or on-chain, are peer-to-peer and settle directly between the buyer and the creator's own wallet. We do not:
- Process payments or take custody of funds at any point
- Store private keys or control any wallet
- Issue, guarantee, insure, or reverse payments or refunds
Zapable is a self-serve platform that only facilitates the transaction. Once a Bitcoin payment is broadcast it is final and irreversible.
You are solely responsible for the accuracy of your own wallet details. If a creator enters a wrong, mistyped, or otherwise incorrect Bitcoin address or extended public key (xpub/ypub/zpub), funds may be sent somewhere they cannot be recovered. Because we never hold or control funds, we cannot recover, reverse, or refund any payment, including one caused by an incorrect address, underpayment, overpayment, or sending on the wrong network. Creators are responsible for their wallet details, refund commitments, disputes, customer support, and any applicable taxes. Buyers are responsible for reviewing the product and creator before purchase and for sending the exact amount to the exact address shown at checkout.
4.2 Stripe Payments (Fiat)
If you choose to subscribe via Stripe, you agree to Stripe’s terms.
We may charge fees for premium features, Pro memberships, or other services.
5. Content Guidelines
Creators can upload digital content such as:
- Guides
- Courses
- PDFs
- Audio files
- Videos
Content must follow our Acceptable Use Policy (AUP).
We reserve the right to remove content or restrict accounts.
6. Marketplace Access and Ranking
We may:
- Feature certain products
- Rank products based on relevance, quality, and trust signals
- Prioritize Pro creators
We do not guarantee visibility or sales.
7. Intellectual Property
Creators retain ownership of their uploaded content.
By uploading, you grant Zapable a non-exclusive license to:
- Store the files
- Display product pages
- Deliver purchased content to buyers
Buyers receive a personal-use license only.
8. Prohibited Use
You must not:
- Upload illegal or harmful content
- Sell prohibited items
- Engage in fraud or scams
- Use Zapable for unlawful financial activity
- Attempt to bypass security or restrictions
9. Refunds and Payment Finality
Bitcoin Lightning and on-chain Bitcoin payments are final, irreversible, and non-custodial. Zapable does not hold buyer funds, does not control the creator's wallet, and cannot reverse, claw back, retrieve, guarantee, or issue a refund for a Bitcoin payment.
Any Bitcoin refund is a separate voluntary transaction from the creator to the buyer. Creators are responsible for honoring any refund window, satisfaction guarantee, or product-specific promise they advertise. Buyers should review the product, creator, payment method, and refund terms before paying.
Zapable may help route support requests, investigate abuse, remove listings, or restrict accounts that violate these Terms, but those platform actions do not mean Zapable can force, fund, or guarantee a Bitcoin refund.
Card payments are processed through Stripe and card networks. Card refunds, disputes, reversals, and chargebacks may be subject to Stripe's terms, card-network rules, applicable law, and the creator's product terms. See our Refund Policy for more detail.
10. Termination
We may suspend or terminate your account if you violate these Terms or the AUP.
You may delete your account anytime.
11. Disclaimer of Warranties
Zapable is provided “as is.” We do not guarantee uptime, sales, or perfect functionality.
12. Limitation of Liability
We are not liable for:
- Lost earnings
- Lost Bitcoin
- Data loss
- Disputes, refunds, or chargebacks between creators and buyers
13. Changes to Terms
We may update these Terms. We will ask you to review and accept material changes the next time you use Zapable. Continued use implies acceptance.
14. Governing Law and Disputes
These Terms are governed by Spanish law. If you are a consumer in the EU, you also benefit from any mandatory consumer-protection provisions of the law of your country of residence, and you may bring claims before the courts of your place of residence. For all other disputes, the courts of Barcelona, Spain have jurisdiction.
Before any formal claim, please contact us at support@zapable.net — we try to resolve every dispute directly. Spanish consumers may also use the consumer arbitration system (Sistema Arbitral de Consumo).
